Ontario Family Lawyer
When facing possible divorce, separation, marriage, adoption or custody issues call a family lawyer. Ontario has a wide range to choose from, and depending on the needs of their clients, these attorneys can act as private consultants regarding procedures and recent law, as legal representatives if court is a necessary option, or as mediators in arriving at a satisfactory solution out of court.
Many issues regarding the law and courts are disconcerting, and none more than those concerns that demand the attention of a family lawyer. Ontario, and more broadly Canada, have legislated many specific guidelines for these J.D.'s to follow as they guide their clients through a case. Most importantly, in regards to child or develop-mentally disabled adult custody, the law clearly states that decisions must be made with the best interests of the child in mind.
This means that when an Ontario family lawyer is presenting a case, they will seek evidence that will assist in proving their client's strengths as a caretaker and provider. An important facet to this is a clause which states that no evidence of unlawful misconduct, poverty, or miscellaneous misdeed is admissible as proof of the inability to care for a child unless it specifically relates to violent behavior, sexual abuse or total negligence.
An Ontario family lawyer may also represent a child seeking emancipation from his or her parent or legal guardian. These cases are often rife with opposition and controversy, and are a relatively recent phenomenon. For a lawyer to decide to take on a case of this nature, he or she must first feel that there is appropriate recourse for the presentation of their case before the court.
Then, as in all other family court proceedings, the correct paperwork must be filled out, motions made and court dates arranged, if necessary. There is always the possibility of settling out of court, but this is dependent upon the willingness of the parties involved. If one side is unwilling to budge on an issue, it must be brought before the court.
It is precisely the finality and personal nature of family law that demands such a delicate and wise approach from its representatives in the legal profession. Although there are always exceptions, those attorneys who tend to gravitate toward family law often have families of their own, and can therefore act as compassionate helpers for their clients.
